Terms and Conditions of participation of Laufstatt Event gGmbH

Preamble:

Laufstatt Event gGmbH (hereinafter referred to as the “Organizer”), Kirchenstraße 21, 81675 Munich, is a non-profit organization that promotes sports and exercise for all age groups in Munich.

The Organizer is the organizer of the MARATHON MÜNCHEN by Brooks 2026.

These General Terms and Conditions (hereinafter also referred to as “Conditions of Participation”) govern the contractual relationship between the participants and the Organizer with regard to the competitions organized by the Organizer as part of the MARATHON MÜNCHEN 2026 (such as the marathon, half marathon, 10 km run, marathon relay, etc.).

For reasons of better linguistic readability, the simultaneous use of masculine, feminine, and non-binary (m/f/d) language forms is dispensed with. All references to persons, even if they contain exclusively “masculine,” “neutral,” or “feminine” formulations, such as “participant” or “runner,” therefore apply equally to all genders and explicitly exclude no one on the basis of their gender or their identification with regard to the question of their gender.

§ 1 General (subject matter of the contract, scope of application, amendments)

These conditions of participation conclusively govern the contractual relationship between the organizer and the participants in the respective competition. Deviating conditions of the participant will not be recognized unless the organizer has expressly agreed to them in writing (the replacement of the written form by electronic form is excluded).

The organizer reserves the right to change these conditions of participation at any time and without giving reasons. Participants will be notified of any changes in good time. If no objection is received within two weeks of receipt of the notification of change, the changed conditions of participation shall be deemed to have been accepted by the participant.

All competitions organized by the organizer will be conducted in accordance with the valid International Competition Rules (IWR) of the German Athletics Association (DLV) and World Athletics (WA). Compliance with these rules is monitored by the DLV competition supervisor. For special competitions such as the marathon relay, the Friendship Run, and the Kids Run, the respective organizational regulations of the organizer, as set out in these conditions of participation, also apply.

The sporting rules listed here are regularly updated by the aforementioned institutions to ensure fair competition. Any changes will be announced in good time.

Note

The marathon and half marathon courses are eligible for best lists and recognized for records.

Due to the net gradient of 21 meters, the 10 km course is not eligible for best times and cannot be used for direct qualification for championships.

The times achieved are included in the WA ranking in the World Athletics Ranking with a point deduction in accordance with Rule 7.2.4 (“Downhill Courses”).

For orders placed via a separate web shop (e.g., merchandise, medal engraving), the organizer’s additional terms and conditions apply.

Each person participating in the events (“participant”) is responsible for checking whether they have the necessary health and fitness and are in an appropriate state of training.

§ 2 Registration, conclusion of contract, scope of services

Registration for the competitions organized by the organizer must be completed by the deadline specified in the respective announcement using the online registration form on the organizer’s website, available at: https://marathonmuenchen.org.

Before submitting the online registration, all data can be checked again for input errors.

Registration for the respective competition is possible until the respective registration deadline specified in the announcement. All registrations are subject to the respective participant quota not yet being exhausted. Once the quota has been reached, no further registrations are possible.

The registration deadline is September 27, 2026. 

Each participant may only register once for the respective competition.

A contract between the organizer and the participant is only concluded once the organizer has sent the participant a confirmation of registration by email after the participant has registered online.

This email will contain the terms and conditions of participation and the text of the contract, including the data entered during registration.

The organizer will send the participants confirmation of participation by email approximately 10 days before the event.

In relay races, relay members may be replaced free of charge. The order of the runners is freely selectable and has no influence on the certificate.

Anyone who registers as a group guarantees that they are authorized to register all group members and to make all necessary declarations on behalf of the group members. The registrant shall inform the group members about these conditions of participation and the data protection information.

Registrations by minors are generally not permitted. Insofar as there are specially approved children’s and youth competitions, minors may only be registered by their legal guardians.

An upgrade to a longer distance is possible upon payment of the surcharge valid at the time of the upgrade, subject to the availability of places in the upgrade category. No refund of the difference will be made for a downgrade to a shorter distance. A processing fee of €15 per change will be charged for changing the distance. These changes can be made until the registration deadline on September 27, 2026, at 11:59 p.m.

Timing will be carried out exclusively using disposable RFID chips provided by the organizer or its agents.

§ 3 Payment terms

Payment of the participation fee and any costs for additional services (e.g., medal engraving) shall be made by SEPA direct debit, credit card, or PayPal. Some additional options can only be booked retrospectively by credit card. Participants have no claim against the organizer for a specific payment option.

The participation fees are usually collected immediately after confirmation of registration. If the payment fails (e.g., due to insufficient funds), the right to a starting place is forfeited.

All prices quoted are gross prices in euros.

If a direct debit is not honored due to insufficient funds or revocation by the participant (even retrospectively), the organizer reserves the right to withdraw from the contract after setting a deadline. The participant shall bear the costs of the return debit, including a processing fee of €10 and any additional fees charged by the credit institution, unless otherwise specified in these terms and conditions of participation.

The following processing fees are payable by the participant to the organizer:

  • Failed debit (entry fee): €10 
  • Failed debit (additional services): €3 

General processing fee for special cases: €15. Special cases include, in particular: manual corrections due to incorrect participant information, such as incorrect bank details, unclear allocation of payment, or missing mandatory information, or subsequent additions or rebookings of chargeable additional services that require separate processing by the organizer and are not otherwise regulated.

§ 4 Failure to attend the competition, revocation, implementation

Unless otherwise agreed in these conditions of participation, the statutory provisions on withdrawal and revocation apply. After registering for a competition via the organizer’s website, participants have no statutory right of revocation in accordance with § 312g paragraph 2 no. 9 BGB (German Civil Code).

If a participant declares that they do not wish to adhere to the contract of participation or does not participate on the day of the competition for other reasons (no show), there is no entitlement to a refund of the participation fees or the fees for additional services. The same applies to the exclusion or disqualification of the participant.

Cancellation is not possible. Instead, a transfer to another person can be made until the registration deadline (September 27, 2026). The original participant will receive a voucher to pass on, valid exclusively for competitions of the MARATHON MÜNCHEN 2026; a cash payment is excluded. The transfer can be made via the official registration system or the organizer. The fee for the transfer is: $20 marathon / $15 half marathon / $12 10 km run.

The organizer is exempt from its obligation to perform in cases of force majeure within the meaning of § 11 of these conditions of participation. In the event of cancellation by the organizer due to force majeure, fees already paid will be refunded; further claims by the participant are excluded, unless this is contrary to a case of exclusion of limitation of liability/exclusion of liability in accordance with § 8 of these conditions of participation.

In cases of official orders or for safety reasons, the organizer may make changes to the implementation, cancel the respective event in whole or in part, or withdraw participants’ starting rights, unless this is contrary to one of the mandatory liability provisions of § 8 of these conditions of participation. In such cases, there shall be no entitlement to a refund of participation fees already paid. This shall also apply if the event has already begun and must be canceled due to official orders or for safety reasons.

§ 5 Conditions of participation, obligations of participants

The participant undertakes to provide only true and complete information when registering and to update this information as necessary.

Only those persons who meet the respective requirements (e.g., age limits) and have paid the full participation fee on time or for whom the full participation fee has been paid on time (e.g., by legal guardians when registering minors for specially approved children’s and youth competitions) are eligible to participate.

Participation in the respective competition is only permitted for participants above a certain minimum age, which varies depending on the competition. Participants must have reached the prescribed minimum age at the time of the respective competition. The minimum age and, in individual cases, maximum age limits are set as follows:

  • Marathon: born in 2008 or earlier
  • Half marathon: born in 2006 or earlier
  • 10 KM: born in 2014 or earlier
  • Marathon relay: born in 2014 or earlier
  • Friendship Run: from 6 years of age, no upper age limit
  • Kids Run: ages 6 to 14

Participation requires that the participant is sufficiently trained and physically healthy. The participant assures that they will only compete on the day of the event if they are healthy and sufficiently trained. If there are any doubts about their health, the organizer may exclude the participant from the race. Participants are encouraged to undergo a medical examination before the competition.

By registering for the event, participants accept the DLV Anti-Doping Code (DLVADC) and undertake to comply with its provisions and the German Athletics Regulations (DLO) of the DLV (in particular § 5.1.1 and § 5.1.2).

Each participant will receive the start number assigned to them by the organizer on site upon presentation of their confirmation of participation (or ID card and, if applicable, power of attorney). The official start number must be worn clearly visible on the chest and may not be altered, made unrecognizable, or damaged in any other way.

Participants are obliged to check the documents received when collecting their start number for completeness immediately upon receipt. Complaints submitted at a later date cannot be considered.

In particular, it is prohibited to leave or shorten the course, to be accompanied by non-participants (e.g., bicycles, inline skates, e- scooters, etc.) or to use any other aids that violate the International Competition Rules (IWR).

The instructions of the organizer and its agents (e.g., medical personnel, marshals, security personnel) must be followed at all times. Failure to comply may result in exclusion from the competition without prior warning or caution.

The organizer is entitled and, under certain circumstances, even obliged to reschedule, shorten, partially or completely cancel, close, or cancel the event in justified cases (e.g., concrete danger to life and limb).

§ 6 Disqualification

A participant will be excluded from the event and disqualified if they violate the conditions of participation or the international competition rules, fail to follow the organizer’s instructions, or if there is another important reason for exclusion or disqualification.

The organizer and the competition jury may exclude participants from the event in the following cases in particular, but not exclusively:

  • Missing transponder or manipulation – Participation without the designated transponder or suspicion of manipulation (e.g., missing split times, shortening the course).
  • Incorrect registration data – incorrect information provided during registration.
  • Suspension – a suspension by the DLV or World Athletics (formerly “IAAF”) at the time of the start.
  • Doping – suspicion or evidence of doping.
  • Health concerns – if there are medical reasons that make participation dangerous.
  • Altered race number – any type of alteration to the race number, e.g., removal or falsification of imprints.
  • Violations of competition rules – rule violations in accordance with the regulations of the respective competition that lead to disqualification.
  • Transfer of start number – passing on the start number.
  • False start – starting without a start number or with multiple transponders.
  • Minimum age – being below the required minimum age.
  • Maximum age – Exceeding the maximum age limit, if specified.
  • Accompaniment – Participation with means of transportation such as bicycles, e-scooters, or inline skates, carrying baby joggers or animals.
  • Relay rules – Violations such as too many relay members, transponders being handed over outside the transition zone, or starting without a transponder.
  • Following instructions from event staff – Failure to heed or follow the instructions of event staff may result in disqualification.
  • Other important reasons – Reasons for exclusion or disqualification that, based on their severity, correspond to one of the reasons listed above.

The organizer reserves the right to exclude participants who use the event for unauthorized activities that damage the reputation of the organizer or its sponsors (e.g., unauthorized advertising on clothing). Participants may apply for permission for such activities no later than four weeks before the event. However, there is no entitlement to such permission.

In the event of disqualification, there is no entitlement to a refund of entry fees or additional services.

An appeal against a disqualification or classification may be lodged within 24 hours after the race (the “appeal period”) by email to ([info@marathonmuenchen.de](mailto:info@marathonmuenchen.de)).

The organizer reserves the right to disqualify participants in the event of serious violations even after the appeal period has expired; such disqualification shall remain effective vis-à-vis the participant concerned despite the expiry of the appeal period.

§ 7 Data protection

The organizer collects and processes the personal data of participants provided during registration in order to carry out and organize the event. This includes, in particular, the information required for payment processing and communication.

Participants expressly consent to the publication of their personal data, such as surname, first name, gender, age group, place of residence, club, start number, rankings, and times (results) in all event-related media, including online media (e.g., live streams), print media, apps, and television.

Participants agree that all photos and/or videos and/or interviews relating to them and created in connection with their participation in the event may be distributed and published in various media (such as radio, television, the internet, including social networks, live streaming, apps, or print materials such as posters, flyers, and program booklets) without any claim to compensation.

By agreeing to the online registration, participants consent to their personal data being passed on to the following companies for the following purposes:

mika:timing GmbH – timekeeping, results lists, and publication;

Marathon Photos – photo flat rate and video;

Brevo – newsletters and e-mailings;

MK Gravurservice – medal engraving.

Abbott World Marathon Majors Age Group Championships

The MARATHON MÜNCHEN by Brooks is an official qualifying race for the Abbott World Marathon Majors Age Group Championships. In order to carry out the evaluation, the following data will be transmitted to World Marathon Majors LLC, 21660 W Field Parkway, Deer Park, IL 60010, USA, with the express consent of the participants: first name, last name, date of birth, nationality, gender, net time, rankings.

The data will be transmitted exclusively for the purpose of conducting and evaluating the Abbott WMM Age Group ranking. Consent to the transfer of data is given during registration via a checkbox.

Participants agree that the organizational host may use their stored personal data for informational purposes in connection with the event.

Personal data will not be passed on to third parties for sale.

Participants have the right to object to the transfer of their personal data by notifying the organizer in writing.

Note: Certain event-related data (name, year of birth, club, times, etc.) is required for participation in the event and will not be deleted despite the participant’s objection if the participant takes part in an event despite objecting to the transfer of personal data.

In addition to cases of explicit consent by participants, the organizer is also entitled to process personal data if the processing is necessary to safeguard the legitimate interests of the organizer, unless the interests or fundamental rights and freedoms of the participants concerned, which require the protection of personal data, prevail.

The legal basis for the processing of personal data is

  • in the case of consent: Art. 6 (1) (a) GDPR,
  • in the case where processing is necessary for the performance of a contract to which the participant concerned is party or in order to take steps at the request of the participant concerned prior to entering into a contract: Art. 6(1)(b) GDPR,
  • in the case that processing is necessary for compliance with a legal obligation to which the organizer as controller is subject: Art. 6 (1) (c) GDPR
  • in the event that processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the organizer as the controller: Art. 6(1)(e) GDPR,
  • in other cases where processing is necessary to safeguard the legitimate interests of the organizer as the controller or a third party, unless the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data prevail: Art. 6(1)(f) GDPR

Further information on data protection, in particular on the purposes of processing, the legal basis and the rights of data subjects, can be found in the privacy policy of Laufstatt Event gGmbH at http://www.marathonmuenchen.org/datenschutz/, whose information and provisions also apply accordingly to events organized by the organizer to which these conditions of participation apply.

§ 8 Liability

The organizer accepts no liability for health risks arising from participation, unless one of the liability cases specified in this § 8, which are mandatory for the organizer (e.g., intent or gross negligence or culpable injury to life, limb, or health through the fault of the organizer), applies.

The costs of medical treatment and other medical measures on site shall be borne by the participant, unless otherwise specified in the provisions on exclusion of liability and mandatory liability of the organizer in this § 8.

The organizer is not liable for damage to the timing chip caused by improper handling or external influences after it has been issued, unless the organizer can be accused of intent or gross negligence.

The organizer shall be liable without limitation for damage caused intentionally or through gross negligence, in the event of fraudulent concealment of defects, and in the event of the assumption of a quality guarantee. The organizer shall also be liable without limitation for claims arising from the Product Liability Act and for damage resulting from culpable injury to life, limb, or health.

The organizer is liable for other damages in accordance with the statutory provisions, provided that a material contractual obligation (cardinal obligation) has been culpably breached. Cardinal obligations are those which the contract, according to its content and purpose, specifically imposes on the organizer or whose fulfillment is essential for the proper execution of the contract and on whose compliance the participant regularly relies and may rely. In this case, liability is limited to the foreseeable damage typical for this type of contract, provided that the organizer is not guilty of intent.

Subject to the above provisions of this § 8, in which no limitation of liability is possible in the event of slight negligence (e.g., in the event of culpable injury to life, limb, or health), liability in the event of slight negligence is limited to the amount of the foreseeable damage that can typically be expected to occur.

The above provisions on limitations of liability and mandatory liability also apply to the organizer’s vicarious agents. For clarification: any exclusion or limitation of liability for damages resulting from injury to life, limb, or health based on an intentional or negligent breach of duty by a vicarious agent of the organizer is excluded.

Otherwise, the organizer’s liability is excluded.

§ 9 Sustainability

The organizer strives to make the event as sustainable and environmentally friendly as possible. In the course of this, changes may occur in the organization or in the offer. Participants will be informed of any changes in good time. There is no entitlement to reimbursement in the event of changes due to sustainability measures.

§ 10 Kids Run

Only children aged 6 to 14 are eligible to participate in the Kids Run.

Registration may only be carried out by legal guardians. Group registrations by schools or clubs are only permitted if a written declaration of consent from the legal guardians is available for each child to be registered.

By registering, legal guardians confirm that there are no health concerns preventing the registered child from participating and that the child is physically capable of participating in the event.

Duty of supervision:

Legal guardians remain responsible for supervising their children throughout the entire event. The organizer does not assume any responsibility for childcare or supervision, especially outside the cordoned-off running route.

Liability:

Legal guardians are liable for any damage caused by participating children within the scope of the statutory provisions. The organizer’s limitations of liability under § 8 of these General Terms and Conditions also apply to the participation of minors.

Accompanying children on the course, in particular, but not limited to, with bicycles, inline skates, scooters, e-scooters, and other sports equipment or with animals is not permitted.

The Kids Run is primarily intended to promote the enjoyment of exercise. Scoring is based exclusively on the criteria specified by the organizer.

Data protection and image rights:

The organizer is entitled to take and publish photos and videos during the event, even without the express consent of the legal guardians, provided that

  • the recordings are used exclusively for the purposes of event reporting, advertising, and documentation,
  • the children depicted are not identifiable or the recordings do not unlawfully violate any personal rights, and
  • the processing is based on the legitimate interest of the organizer in accordance with Art. 6 (1) lit. f GDPR, 
  • unless the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data prevail.

Legal guardians have the right to object to the use of images and video recordings of their child at any time.

The objection must be addressed to the organizer. For reasons of verifiability, the objection must be made in writing; verbal objections must be proven to the organizer in writing by the objecting party without delay.

In the event of a verifiable objection, further use of the relevant recordings will be discontinued and recordings that have already been published will be deleted or made unrecognizable, insofar as this is technically and factually possible (taking into account the interests of the parties involved, in particular the economic reasonableness of the measures for the organizer).

In all other respects, the provisions of these General Terms and Conditions shall apply accordingly,

unless otherwise specified in the above provisions.

§ 11 Force majeure

The organizer is released from its obligation to perform in cases of force majeure.

Force majeure includes all unforeseen events and events

the effects of which on the performance of the contract are beyond the control of either party.

These events include, in particular, but are not limited to, fire damage, floods, pandemics, epidemics, lawful industrial action (in particular strikes and lockouts) – including in third-party companies – as well as official measures, in particular official orders and directives.

§ 12 Final provisions

Contracts between the organizer and the respective participant are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods (“CISG”).

The participant’s ability to invoke the consumer protection rights of the EU member state in which the participant is resident remains unaffected by this.

Amendments and additions to the contract and these conditions of participation must be made in writing.

This also applies to any amendment to this provision.

There are no verbal side agreements.

Should individual clauses of these conditions of participation be invalid and/or unenforceable or become invalid and/or unenforceable during the term of the contract, this shall not affect the validity of the remaining provisions.

The invalid clause shall be replaced by a provision that comes as close as possible to the economic purpose.
