Conditions of participation of Laufstatt Event gGmbH

Preamble: Laufstatt Event gGmbH (hereinafter referred to as the “Organiser”), Kirchenstraße 21, 81675 Munich, is a non-profit organisation that promotes sport and exercise for all age groups in Munich. The Organiser is the organiser of the MARATHON MÜNCHEN 2025. These conditions of participation govern the contractual relationship between the participants and the Organiser with regard to the organised competitions (e.g. marathon, half marathon, 10 km run, marathon relay etc.).

For reasons of better readability, the simultaneous use of the language forms male, female and non-binary (m/f/d) is dispensed with. All personal designations apply equally to all genders.

§ 1 General (subject matter of the contract, scope of application, amendments)

  1. These conditions of participation conclusively regulate the contractual relationship between the organiser and the participants of the respective competition. Deviating conditions of the participant are not recognised unless the organiser has expressly agreed to them.
  2. The organiser reserves the right to change these conditions of participation at any time and without giving reasons. Participants will be notified of any changes in good time. If no objection is raised within two weeks of receipt of the notification of change, the amended conditions of participation shall be deemed to have been accepted by the participant.
  3. All competitions organised by the organiser are carried out in accordance with the valid International Competition Rules (IWR) of the German Athletics Association (DLV) and World Athletics (WA). Compliance with these rules is monitored by the DLV competition supervisor. For special competitions such as the Marathon Relay, Fiendship Run and Kids Run, the respective organisational regulations of the organiser, regulated in these conditions of participation, also apply. The sporting rules listed here are regularly updated by the above-mentioned institutions in order to ensure a fair and sporting competition. Possible changes will be announced in good time
  4. For orders placed via a separate web shop (e.g. merchandise, medal engraving), additional general terms and conditions of the organiser apply.
  5. Each person taking part in the events (“participant”) is responsible for checking whether they have the necessary medical fitness and appropriate level of training.

§ 2 Registration, conclusion of contract, scope of services

  1. Registration for the competitions organised by the organiser must be made by the deadline stated in the announcement using the online registration form on the organiser’s website, available at: www.marathonmuenchen.org. Before submitting the online registration form, all data can be checked again for input errors.
  2. Registration for the respective competition is possible until the respective closing date stated in the announcement. All registrations are subject to the proviso that the respective quota of participants has not yet been exhausted. As soon as the quota has been reached, no further registration is possible.
  3. If there are still places available, the organiser will allow late registrations approx. 10 days before the event. Late registration will be set up online on the event website. There may be different late registration times for certain races, which are specified in the announcement.
  4. Each participant can only register once for the respective competition. 
  5. A contract is concluded as soon as the organiser sends the participant a confirmation of registration by email after the participant has registered online. With this e-mail, the participant receives the conditions of participation and the text of the contract, including the data entered during registration.   
  6. The organiser will send the confirmation of participation to the participants by e-mail approx. 10 days before the event.
  7. Participants residing within the EU have the option of booking the postal delivery of the starting documents by parcel for an additional charge. 
    • This service can be booked for a fee for the marathon, half marathon and marathon relay up to approx. 14 days before the event.  
    • The dispatch of the starting documents is expected to take place approx. 10 days before the respective competition.
    • If the parcel cannot be delivered (e.g. due to an incorrect address, absence or non-collection at a packing station), it is the participant’s responsibility to collect the starting documents in person at the start number distribution point. Another delivery attempt will not be made for organisational reasons. The dispatch fee will not be refunded in this case. Any costs incurred as a result of the return shipment are to be borne by the participant.
  8. Anyone who registers a group guarantees that they are authorised to register all group members and to make all necessary declarations on behalf of the group members. The applicant shall inform the group members of these conditions of participation and the data protection information.
  9. Registrations by minors are generally not permitted. If there are specially authorised children’s and youth competitions, minors may only be registered by their legal guardians.
  10. An upgrade to a longer distance is possible against payment of the surcharge applicable at the time of the upgrade. If you downgrade to a shorter distance, the difference will not be refunded. In addition, a processing fee of €15 will be charged. These changes can be made until the registration deadline on 28 September 2025 at 23:59.
  11. Timekeeping is carried out exclusively by means of a disposable RFID chip, which is provided by the organiser or his vicarious agents. 

§ 3 Payment 

  1. Payment of the participation fee and any costs for additional services (e.g. medal engraving, shipping) is made by SEPA direct debit or credit card. Subsequent bookings of additional options can sometimes only be made by credit card.
  2. The participation fee is usually collected immediately after confirmation of registration. Should the payment fail (e.g. due to insufficient funds), the entitlement to the starting place is cancelled.
  3. All prices are gross euro prices. 
  4. If a direct debit is not honoured due to insufficient funds in the account or revocation by the participant (even retrospectively), the organiser reserves the right to withdraw from the contract after setting a deadline. The participant shall bear the costs of the returned direct debit, including a processing fee of 10 € and any fees charged by the credit institution.

§ 4 Non-participation in the competition, cancellation, implementation

  1. Unless otherwise agreed in these conditions of participation, the statutory provisions on cancellation and withdrawal apply. After registering for a competition via the organiser’s website, there is no statutory right of withdrawal in accordance with Section 312g (2) No. 9 BGB.
  2. If a participant declares that he/she does not wish to adhere to the participation contract or does not appear on the day of the competition for other reasons (no show), there is no entitlement to a refund of the participation fees or for additional services. The same applies to exclusion or disqualification.
  3. Transferring the registration to another person is not permitted. 
  4. The organiser is exempt from the obligation to perform in cases of force majeure within the meaning of § 10 of these conditions of participation. In the event of cancellation by the organiser, any fees already paid will be refunded; any further claims are excluded unless the exclusion of the limitation of liability/exclusion of liability pursuant to § 9 of these Conditions of Participation applies. 
  5. The organiser may, in cases of official orders or for safety reasons, make changes to the event, cancel the event in whole or in part or withdraw the starting rights. In such cases, there is no entitlement to a refund of participation fees already paid. This also applies if the event has already started and has to be cancelled.

§ 5 Participation requirements, obligations of the participants

  1. The participant undertakes to provide true and complete information when registering and to update this information if necessary. 
  2. Only those persons who fulfil the respective requirements (e.g. age limits) and have paid the full participation fee on time are eligible to participate.
  3. Participation in the respective competition is only permitted for participants over a certain minimum age, which varies depending on the competition. Participants must have reached the prescribed minimum age at the time of the competition. This is determined as follows
    • Marathon: 18 years
    • Half marathon: 16 years
    • 10 KM: 12 years
    • Marathon relay: 12 years 
    • Friendship Run: 6 years – no age limit
    • Kids Run: 6 – 14 years
  4. Participation requires that the participant is sufficiently trained and physically healthy. The participant assures that he/she will only take part on the day of the event if he/she is healthy and in a sufficient state of training. If there are any doubts about the participant’s health, the organiser may exclude the participant from the race. Participants are required to undergo a medical examination before the competition.
  5. By registering for the event, the participant recognises the DLV Anti-Doping Code (DLVADC) and undertakes to comply with its provisions and the DLO (in particular § 5.1.1 and § 5.1.2). 
  6. The organiser shall provide the participant with a race number with RFID tag in working condition. The participant is obliged to check it for visible defects upon receipt and to report any defects immediately.
  7. Each participant will receive their race number on site on presentation of their confirmation of participation (or identity card and authorisation if applicable). The official race number must be worn clearly visible on the chest and may not be altered, defaced or damaged in any other way. 
  8. The participant is obliged to check the completeness of the documents received at the start number issue immediately upon receipt. Complaints submitted later cannot be considered
  9. In particular, it is forbidden to leave or shorten the course, to be accompanied by non-participants (e.g. bicycles, inline skates) or to use other aids that contravene the international competition rules.
  10. The instructions of the organiser and his assistants (e.g. medical staff, marshals, stewards) must be followed at all times. Failure to do so may result in exclusion from the competition.
  11. In justified cases (e.g. specific danger to life and limb), the organiser is entitled and, under certain circumstances, even obliged to postpone, shorten, completely or partially interrupt, close or cancel the event.

§ 6 Disqualification

  1. A participant will be excluded from the event and disqualified if he/she violates the conditions of participation or the international competition rules or does not follow the instructions of the organiser.
  2. The organiser and the competition jury may exclude participants from the event in the following cases:
    • Missing transponder or manipulation: Participation without the intended transponder or suspected manipulation (e.g. missing split times, course shortening).
    • Incorrect login details: Incorrect information during registration.
    • Ineligibility: A ban by the DLV or the IAAF at the time of the start.
    • Doping: Suspicion or evidence of doping.
    • Health concerns: If there are medical reasons that make participation dangerous.
    • Altered start number: Any type of alteration to the start number, e.g. removal or falsification of imprints.
    • Offences against competition rules: Violations of the rules in accordance with the regulations of the respective competition that lead to disqualification.
    • Transfer of the start number: Transfer of the start number.
    • Wrong start: Start without a start number or with several transponders.
    • Minimum age: Below the required minimum age.
    • Accompaniment: participation with means of transport such as bicycles or inline skates, carrying baby joggers or animals
    • Relay rules: Infringements such as too many relay team members, transponder handover outside the transition zone or starting without a transponder.
    • Failure to follow the instructions of the event staff: Failure to follow the instructions of the event staff may result in disqualification.
  3. The organiser reserves the right to exclude participants who use the event for unauthorised activities that damage the reputation of the organiser or its sponsors (e.g. unauthorised advertising on clothing). Participants can obtain authorisation for such activities up to four weeks before the event at the latest. 
  4. In the event of disqualification, there is no entitlement to a refund of entry fees or additional services.
  5. An appeal against a disqualification or classification is possible within 24 hours after the race by e-mail (info@marathonmuenchen.de ).
  6. The organiser reserves the right to disqualify an athlete in the event of serious infringements, even after the objection period has expired.

§ 7 Data protection

  1. The organiser collects and processes the personal data of the participants provided during registration in order to carry out and organise the event. This includes in particular the information required for payment processing and communication.
  2. Participants expressly agree to the publication of their personal data such as surname, first name, gender, age group, place of residence, club, start number and placings and times (results) in all event-related media, including online media (e.g. live streams), print media, apps and television.
  3. Participants agree that all photos, videos or interviews taken in connection with their participation in the event may be distributed and published in various media (such as radio, television, internet, including social networks, live streaming, apps or print materials such as posters, flyers and programme booklets) without any right to compensation
  4. By giving their consent when registering online, participants agree to their personal data being passed on to the aforementioned companies for the following purposes:
    • mika:timing GmbH, Odenthaler Straße 153, 51465 Bergisch Gladbach: Participants agree that the organising promoter may transmit their personal data (surname, first name, address, gender, year of birth, nationality, club, start number) to mika:timing GmbH. This data will be stored and processed for the purpose of timekeeping, the creation of starter and result lists with placings and their publication on the Internet and, if applicable, in the app.
    • Marathon Photos, 170 Collingwood Street, 3204 Hamilton, New Zealand: If booked, participants agree that their first name, surname, race number, the language selected in the registration and their e-mail address will be passed on to Marathon Photos and stored for the photo flat and the video.
    • DHL, Sträßchensweg 10, 53113 Bonn: If booked, participants agree that their first name, surname, address, telephone number and e-mail address will be passed on to the service provider DHL and stored in order to enable the dispatch of the starting documents.
    • If subscribing, participants agree that their first name, surname, gender and e-mail address will be passed on to the service provider Brevo and stored to enable the newsletter and e-mailings to be sent
  5. Participants agree that the organiser may use their stored personal data for information purposes in connection with the event.
  6. Personal data will not be passed on to third parties for sale.
  7. Participants have the right to object to the disclosure of their personal data by notifying the organisational organiser in writing.
  8. Note: Certain event-related data (such as first name, surname, year of birth, nationality, club, start number, ranking and times) are required for the event and will not be deleted.
  9. Further information on data protection can be found in the privacy policy of Laufstatt Event gGmbH, which is available at www.marathonmuenchen.org/datenschutz/.

§ 8 Liability 

  1. The organiser accepts no liability for health risks arising from participation, unless one of the liability cases specified in this standard (e.g. injury to life, limb or health through the fault of the organiser) applies. Medical treatment and other medical measures on site are to be borne by the participant.
  2. The organiser is not liable for damage to the timing chip caused by improper handling or external influences after it has been issued.
  3. The organiser shall be liable without limitation for damage caused intentionally or by gross negligence, in the event of fraudulent concealment of defects and in the event that a guarantee of quality has been given. The organiser shall also have unlimited liability for claims arising from the Product Liability Act and for damages resulting from injury to life, limb or health.
  4. The organiser shall only be liable for other damages if an essential contractual obligation (cardinal obligation) has been breached, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the participant may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.
  5. In the event of slight negligence, liability shall be limited to the amount of foreseeable damage that can typically be expected to occur.
  6. The above provisions shall also apply to the organiser’s vicarious agents.
  7. Liability is otherwise excluded. 

§ 9 Sustainablity

  1. The organiser strives to make the event as sustainable and environmentally friendly as possible. 
  2. This may result in changes to the organisation or the offer. Participants will be informed of any changes in good time. There is no entitlement to a refund in the event of changes due to long-term measures.

§ 10 Force majeure

The organiser is released from the obligation to perform in cases of force majeure. Force majeure includes all unforeseen events as well as events whose effects on the fulfilment of the contract are not the responsibility of either party. These events include, in particular, pandemics, epidemics, lawful industrial action, including in third-party companies, and official measures.

§ 11 Final provisions 

  1. The contracts between the organiser and the respective participant shall be governed exclusively by German law. The possibility for the participant to invoke the consumer protection rights of the EU member state in which the participant is resident remains unaffected by this. 
  2. Amendments and additions to the contract and these conditions of participation must be made at least in text form. This also applies to amendments to this provision. Verbal collateral agreements do not exist.
  3. Should individual clauses of these conditions of participation be invalid and/or unenforceable or become invalid and/or unenforceable during the term of the contract, this shall not affect the validity of the remaining provisions. The ineffective clauses shall be replaced by a provision that comes as close as possible to the economic purpose.
